Alabama Fetus Case Sets Precedent to Define Pre-Born as Person

Al.com – An Alabama judge has decided that a man can be the personal representative of an aborted fetus.

The decision, issued Feb. 6 by Madison County Probate Judge Frank Barger, responded to a request from the man claiming to be the child’s father seeking to create an estate for the child. The judge granted the request.

Ryan Magers, the father of “Baby Roe,” filed a wrongful death lawsuit the same day as Barger’s ruling against the Alabama Women’s Center for Reproductive Alternatives – a Huntsville clinic that performs abortions. In the lawsuit, Magers said he “repeatedly pleaded” with the mother not to terminate the pregnancy.
