Family of Ashli Babbitt plans $10 million lawsuit against U.S. Capitol Police

Joe Biden and his media cronies call it the “insurrection” of Jan. 6 at the U.S. Capitol, though the only fatal casualty of direct violence in the rowdy protest was an unarmed woman wearing a Donald Trump flag around her shoulders.

Now the family of Ashli Babbitt, the California woman fatally shot during the riot, is reportedly filing a multimillion-dollar wrongful death suit against the United States Capitol Police, according to WUSA9, a CBS station.

The Babbitt family is planning to sue the department and the officer who shot her for at least $10 million over the death of the 35-year-old Air Force veteran. Maryland-based Roberts & Wood confirmed to WUSA9 on April 30 that the law firm was working with the Babbitt family, but would not comment further.

Babitt was “fanatical” about loving the United States and trying to get President Donald Trump re-elected, family members say. Her uncle said she came to D.C. on Jan. 6 because she “thought she could influence whatever was happening in Washington that day.” Video taken during the Capitol riot showed Babbitt among the mob trying to break into the Speaker’s Lobby outside the U.S. House of Representatives.

She was shot in the shoulder by a gunman when she attempted to climb through a broken interior window, fell backwards, never got up and died a short time later.

The Justice Department announced earlier this month it would not pursue charges against the officer who shot Babbitt, saying there is not enough evidence to support a criminal prosecution.

“Specifically, the investigation revealed no evidence to establish that, at the time the officer fired a single shot at Ms. Babbitt, the officer did not reasonably believe that it was necessary to do so in self-defense or in defense of the Members of Congress and others evacuating the House Chamber,” the Justice Department said.
