U.S. judge rules Pa. governor’s strict lockdown measures are unconstitutional

Pennsylvania’s liberal Democrat Gov. Tom Wolf has “gone California” on the Keystone State during the coronavirus scare, placing strict limits on crowd sizes, movement of free citizens and business practices, but on Sept. 14 a federal judge put some limits on Wolf.

Like most Democrats Wolf is also obsessed with homosexuality, and, strangely, announced that the state would use COVID-19 data collection to also gather data on Pennsylvanians’ sexual orientations and “gender identity.”

MailOnline is reporting that President Trump praised the Sept. 14 ruling of U.S. District Judge William Stickman IV, whom he appointed, which declared that the lockdown measures imposed by Wolf are unconstitutional.

Wolf’s severe restrictions were challenged by business owners and Republican politicians, who said that they arbitrarily trashed the rights of state residents along with the Pennsylvania economy. Stickman’s ruling declared that while the restrictions were executed with “good intentions,” they were arbitrary and violated individual rights.

” … even in an emergency, the authority of government is not unfettered,” Stickman wrote.

Some of the limits have been eased since a lawsuit was filed in May, but the Democratic governor has held tight to some restrictions on gatherings and on bars and restaurants.

Wolf’s office expressed disappointment with the ruling, and will request a stay of the decision so it can file an appeal. 

The judgment says: “(1) that the congregate gathering limits imposed by defendants’ mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants’ orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of defendants’ orders violate the Equal Protection Clause of the Fourteenth Amendment.”
